Environmental litigation on the horizontal level
a case study in the São Paulo judiciary involving commercial relationships.

The objective of this research is limited to analyzing the competitive market context and environmental non-compliance as two triggering factors for judicial conflicts among business activities. In this context, when two or more companies engage in litigation with each other, this phenomenon is referred to as horizontal-level judicial litigation. In methodological terms, the empirical study is limited to two pilot cases in the São Paulo judiciary, with a focus on the relative use of environmental arguments indirectly intertwined with economic claims as the essence of the dispute. The theoretical references provide insights from foreign researchers regarding the concepts of environmental non-compliance, competition between companies, and litigation. As for the most apparent practical results, the inductive method of case study and the deductive approach from international literature facilitate the understanding of norms, principles, commercial practices, and procedures in connection with environmental defense or economic interests. Thus, two central ideas are highlighted: the prospective view, that is, the Judiciary as an open door for changing trade values regarding the internalization of environmental issues, and skepticism, meaning that companies may relegate the judicial path to a secondary level. Supported by these concepts, it can be concluded that there is a great deal of difficulty in understanding what lies behind the judicialization among business activities when the argument is environmental protection. The most secure answer is the fragmentation between economic and environmental rationality in these horizontal disputes.
