A legal perspective on groundwater governance

Abstract

Law is fundamental to a good groundwater governance. Brazilian states Revista Direito Ambiental e sociedade, v. 12, n. 01, janeiro/abril 2022 (p. 464-494)465are the ones responsible for groundwater management, which must observe the federal legislation guidelines. However, few studies evaluated if or how states have accomplished this duty. The goal of this paper is to analyze groundwater governance in the state of São Paulo based on a set of legal indicators formed by the obligations stablished in the Federal Legislation for water and related topics. For this, a Groundwater Governance Assessment System (SAGAS) was developed, formed by 48 central and 25 subordinate indicators, with a total score of 169 points. The study methodology is based on documental analysis of legislation, scientific literature and government documents Groundwater governance in São Paulo was classified as moderate due to the absence of legal provision or the failure to implement federal and state laws
