A Comparative Analysis between the Netherlands and Turkiye

Resumo

This study built upon an investigation on the efficiency of the court decisions on ‘environmental issues’ with a comparative analysis in between the Netherlands and Turkiye. In this regard, first of all, it provides an overview on European Commission for the Efficiency of Justice (CEPEJ)’s methodology and data referring to its evaluation reports. Secondly, it examines two judicial systems and their relative potential features regarding environmental litigation to understand on which basis a comparative analysis can be made on environmental litigation between Netherlands vs. Turkiye. Finally, based on its findings, two countries’ environmental cases are collected on the basis of a strict period, with a certain environmental case definition and pre-determined instance stage, and, it makes a comparative analysis in between its two case studies.

Zerrin Savaşan está atualmente trabalhando como Associado. Prof. (Direito Internacional Público) no Departamento de Relações Internacionais, Subdepartamento de Direito Internacional, Faculdade de Ciências Econômicas e Administrativas, Universidade Selçuk em Konya, Turkiye. Ela também trabalha como Coordenadora Institucional Erasmus/Farabi da Universidade Selcuk.

Obteve seu doutorado pelo Departamento de Relações Internacionais da Middle East Technical University (METU); seu mestrado pelo Departamento de Estudos Europeus, METU; e seu diploma de bacharel é pela Faculdade de Direito da Universidade de Ancara.

A sua investigação de doutoramento foi conduzida sobre “Mecanismos de Conformidade sob Acordos Ambientais Multilaterais”, apoiada por bolsas concedidas pelo Conselho de Ensino Superior (YOK) da Turquia no Instituto Max Planck de Direito Público Comparado e Direito Internacional, Universidade de Heidelberg, Alemanha; e pelo Programa de Treinamento de Pessoal Acadêmico (OYP) de Turkiye no Centro de Estudos Ambientais da Universidade Vrijie, Amsterdã, Holanda.

Sua pesquisa de pós-doutorado foi conduzida sobre “Melhorando a conformidade por meio de oportunidades de cooperação entre redes informais de conformidade ambiental e acordos ambientais multilaterais”, com uma bolsa concedida pelo Conselho de Pesquisa Científica e Tecnológica da Turquia (TÜBİTAK-2219) no Instituto de Pesquisa Legal Transnacional (METRO ), Faculdade de Direito, Universidade de Maastricht, Maastricht, Holanda.
